Noble Symphony Terms of Use

These Terms of Use ("Terms") govern your use of the Noble Symphony mobile application and related services ("Noble Symphony" or the "Service") provided by Noble HiFi, LLC, doing business as Noble Audio ("Noble Audio," "we," "us," or "our").
By downloading, accessing, or using Noble Symphony, you agree to these Terms. If you do not agree to these Terms, do not use Noble Symphony.
1. Noble Symphony
Noble Symphony is a companion application intended for use with supported Noble Audio products and services.
Features may include product connectivity, device configuration, sound personalization, device management, account functions, firmware-related functions, and other features made available by Noble Audio.
Available features may vary depending on product, mobile device, operating system, geographic region, or software version.
2. Accounts and Third-Party Login
Certain Noble Symphony features may require you to create or use an account.
Noble Symphony may allow you to authenticate through third-party services, including Facebook Login.
Your use of a third-party authentication provider may also be subject to that provider's applicable terms, privacy policies, and other requirements.
You are responsible for maintaining the security of your account and for activity conducted through your account.
You may not impersonate another person, create an account using information you are not authorized to use, or attempt to gain unauthorized access to Noble Symphony or another user's account.
3. License to Use Noble Symphony
Subject to these Terms, Noble Audio grants you a limited, personal, non-exclusive, non-transferable, revocable license to use Noble Symphony for lawful personal use with supported Noble Audio products and services.
Noble Audio retains all rights, title, and interest in Noble Symphony, including its software, interfaces, graphics, trademarks, content, documentation, and other intellectual property.
4. Acceptable Use
You may not:
- Use Noble Symphony for unlawful purposes;
- Interfere with or disrupt Noble Symphony or related systems;
- Attempt to bypass or defeat security measures;
- Attempt to gain unauthorized access to systems, accounts, or data;
- Reverse engineer, decompile, disassemble, or attempt to derive source code except where expressly permitted by applicable law;
- Introduce malicious software, harmful code, or other destructive material;
- Use Noble Symphony in a manner that infringes the rights of another person; or
- Use automated systems or methods to access Noble Symphony in a manner not authorized by Noble Audio.
5. Product, App and Firmware Updates
Noble Audio may provide application, software, configuration, or firmware updates from time to time.
Updates may add, remove, modify, improve, or discontinue functionality.
Certain features or supported products may require an updated version of Noble Symphony or updated firmware.
You should follow all instructions provided when installing firmware or software updates on connected Noble Audio products.
6. Availability and Changes
Noble Audio may modify, suspend, restrict, replace, or discontinue all or part of Noble Symphony where reasonably necessary for maintenance, security, technical, regulatory, commercial, or product-development reasons.
We do not guarantee that every feature will remain continuously available or be compatible with every mobile device, operating system, or Noble Audio product.
7. Third-Party Services
Noble Symphony may interact with services provided by third parties, including authentication providers, operating-system providers, cloud-service providers, and mobile platforms.
Noble Audio does not control and is not responsible for third-party services that are outside our control.
Your use of third-party services may be governed by separate terms and privacy policies provided by those third parties.
8. Privacy
Our collection, use, disclosure, retention, and deletion of personal information through Noble Symphony is described in the Noble Symphony Privacy Policy.
If you use Facebook Login or another third-party authentication service, information received through that service will be handled as described in our Privacy Policy.
9. Intellectual Property
Noble Symphony, the Noble Audio name and logos, related product names, graphics, interfaces, software, documentation, and other materials are owned by or licensed to Noble Audio and are protected by applicable intellectual-property laws.
Nothing in these Terms grants you ownership of Noble Audio intellectual property.
10. Disclaimer
To the maximum extent permitted by applicable law, Noble Symphony is provided on an "as is" and "as available" basis.
Noble Audio does not warrant that Noble Symphony will operate uninterrupted or error-free, or that every feature will be compatible with every mobile device, operating-system version, or Noble Audio product.
Nothing in these Terms excludes any warranty, consumer right, or remedy that cannot legally be excluded.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Noble Audio will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of, or inability to use, Noble Symphony.
Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by applicable law.
12. Termination
You may stop using Noble Symphony at any time.
Noble Audio may suspend, restrict, or terminate access to Noble Symphony where reasonably necessary if you materially violate these Terms, misuse the Service, create a security risk, or where continued access would violate applicable law.
Termination does not affect rights or obligations that by their nature should survive termination.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes to Noble Symphony, our business practices, applicable law, or third-party services.
The current version will be published on this page together with the date of the most recent update.
Your continued use of Noble Symphony after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
14. Governing Law
These Terms are governed by the laws applicable to Noble HiFi, LLC, without limiting any mandatory consumer-protection rights or other rights that apply to you under the laws of your jurisdiction.
